1. Acceptance of Terms

By using any website, mobile app, or service of CJK Home Solutions, LLC (DBA K3 Life Transitions; hereinafter referred to as "CJK"), you agree to abide by these Terms of Use between you and CJK, which include the referenced Privacy Policy ("Agreement"). If you do not agree to be bound by this Agreement, you are not authorized to use any CJK website or obtain any services from CJK.

The CJK websites and mobile apps include CJKHomeSolutions.com and K3LifeTransitions.com (collectively, "Websites"; individually, "Website").

CJK provides numerous services, as referenced on the Websites ("Services").

CJK reserves the right, at its discretion, to revise the terms of this Agreement and/or change, suspend, discontinue, or modify any aspect of any Website. Such modifications may include, without limitation, changes in content, user priorities, and discontinuance of functional aspects of any Website.

Your continued use of any Website after the posting of revisions to the Terms Of Use shall constitute your acceptance to be bound by the express terms of any such revisions.

2. Certification of User

By using or attempting to use this Website, you certify to CJK that you are a resident of the United States or otherwise authorized to conduct business in the United States, are at least 18 years of age or older, and have the legal capacity to enter into this Agreement.

3. Content and Registration

3.1. Website Content: The Website content includes all areas and aspects of the Website and Services, including, without limitation, text, data, photos, graphics, and/or video or any information obtained through the Website (collectively referred to as "Information"), CJK's computers or network, and any subscription or software, product, service, or information provided by CJK.

3.2. Vendor Content: CJK has contractual relationships with certain vendors, sponsors, and advertisers of products or services ("Vendors"). Vendor Content may include information, advertisements, discounts, products, goods, or services offered by Vendors. CJK does not guarantee the availability or accuracy of any Vendor Content or offers and does not endorse or insure any Vendor products or services.

3.3. Liability: CJK shall not be held liable for any loss or damage caused by your use of: (a) any external site linked to the Service, (b) Vendor Information, or (c) Vendor products or services. Statements made on the Service concerning CJK's products or services are solicitations, not offers.

3.4. Registration: You may be required to register and select a user identification and password to access certain aspects of the Website or obtain Services. You agree to maintain the confidentiality of your registration information and use it solely to access the Website and Services. If you believe your registration has been compromised, you must promptly change your information and notify us.

4. Limitations on Use and User Submissions

4.1. Copyright, Patent, and Trademark Notice: All Website content, including text, photos, graphics, audio, software, and video, is copyrighted by CJK Home Solutions, LLC, or its affiliates or subsidiaries. You may not reproduce, distribute, modify, or redistribute any part of the content without CJK's express written consent.

You shall not post or transmit any information that infringes on the rights of others, is unlawful, threatening, abusive, defamatory, vulgar, obscene, or otherwise objectionable, or that is protected by patent, copyright, trademark, or other proprietary rights without permission.

4.3. Submission of Messages: You grant CJK a worldwide, royalty-free, perpetual, non-exclusive right and license to use, reproduce, modify, and distribute any messages or materials you post on the Service.

4.4. Public Messages: Electronic forums provided on the Service are CJK's property and not public forums. CJK is not responsible for Third-Party Content posted by users. You agree not to use the Service to upload, post, or transmit objectionable content.

4.5. Linking: You may not use CJK's proprietary logos, marks, or other distinctive materials in your links without prior written consent. Deep linking is prohibited if it implies affiliation, causes confusion, dilutes trademarks, violates laws, or constitutes improper disparagement.

5. Access and Delays in Services

CJK, its affiliates, subsidiaries, and Vendors are not responsible for providing access to the Website. CJK is not liable for losses or liabilities resulting from delays, inaccuracies, errors, or interruptions of the Service for any reason.

6. Monitoring by CJK

CJK reserves the right to monitor Third-Party Content transmitted or received through the Service for lawful purposes. You consent to such monitoring and other terms of this Agreement.

7. Representations, Warranties, and Limitation of Liability

7.1. General Disclaimer: Certain aspects of the Information and links provided through the Website may have inaccuracies. CJK and its licensors do not warrant the accuracy or suitability of the Information. The Website is provided "as is," and CJK disclaims all warranties.

7.2. Viruses: CJK makes efforts to prevent viruses but does not guarantee the absence of viruses or similar programs. You assume responsibility for detecting and eradicating any viruses.

7.3. Limitation of Liability: CJK and its affiliates, subsidiaries, and Vendors are not liable for special, incidental, or consequential damages arising from the use or inability to use the Service. CJK's liability, if any, is limited to a sum equal to 10% of sums paid to CJK by you under this Agreement or $100.00, whichever is greater.

8. Indemnification

You shall indemnify, defend, and hold CJK and its affiliates, subsidiaries, and Vendors harmless from all losses, claims, demands, and causes of action arising from your use of the Website and Services.

9. Privacy Policies

These Terms of Use include our Privacy Policy on our website, incorporated fully herein.

10. Unsolicited Marketing

10.1. Unsolicited Marketing: CJK does not authorize the use of the Service for unsolicited electronic mail ("SPAM").

10.2. Electronic Direct Marketing Programs: CJK may engage in electronic direct marketing to users who opt to receive specific electronic mail. Users can opt out of such mailings.

10.3. Reporting SPAM: Users can report SPAM or offensive e-mail to CJK for action.

10.4. Reservation of Rights: CJK reserves the right to take legal or technical steps to prevent SPAM or objectionable e-mail over the Service.

11. Miscellaneous

11.1. Governing Law and Venue: This Agreement is governed by the laws of the State of Texas. Any claims arising from this Agreement must be filed within two years and brought in the state or federal courts located in Maricopa County, Arizona.

11.2. Assignments: You may not assign your rights or obligations under this Agreement without CJK's written consent.

11.3. Severability: If any provision of this Agreement is found unlawful or unenforceable, it shall be reformed or deleted

, and the remaining provisions shall remain in full force.

11.4. Connectivity Charges: You may incur third-party connectivity charges while using the Website. You are responsible for these charges.

11.5. Termination: CJK may terminate or suspend your use of the Website. Termination shall not affect any rights or relief to which CJK may be entitled.

11.7. Notice Regarding Electronic Commercial Service for California Users: California users have specific consumer rights under California Civil Code Section 1789.3.

11.8. Entire Agreement: This Agreement constitutes the entire agreement between the parties. Any inconsistencies shall be resolved in favor of the last published Agreement or terms of use.
